This Consumer Health Data Privacy Policy describes how Tara LaFerrara LLC doing business as BROADS (“BROADS,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes Consumer Health Data through the BROADS mobile application (the “Application”), our website (the “Site”), and the memberships, coaching, fitness, tracking, and other services we provide (collectively, the “Services”).

This policy supplements our general Privacy Policy and applies to personal information that constitutes “Consumer Health Data” under applicable consumer health privacy laws, including the Washington My Health My Data Act and Nevada’s consumer health data privacy law.

1. Consumer Health Data We Collect: Consumer Health Data means personal information that is linked or reasonably linkable to an individual and identifies or may be used to identify the individual’s past, present, or future physical or mental health status. Depending on the Services and features you use, we may collect:

  1. Physical characteristics and health measurements, such as height, weight, body measurements, heart rate, body-fat percentage, steps, exercise minutes, active energy, lean body mass, and other health or fitness measurements;

  2. Fitness and activity information, such as fitness goals, activity levels, exercise habits, workout history, workout performance, and progress;

  3. Health and physical-condition information, such as physical limitations, injuries, health concerns, menstrual-cycle information, and other information you choose to provide;

  4. Coaching information, such as health or fitness information contained in questionnaires, check-ins, coach messages, progress updates, photographs, and other coaching communications; and

  5. Information from health, fitness, and wearable services you choose to connect, such as Apple Health, Fitbit, MyFitnessPal, Runkeeper, MapMyRun, Withings, and other services supported through Exercise.com. Information from another service, such as Oura, may also become available through an intermediary service such as Apple Health.

2. Where We Collect Health Data From: We collect Consumer Health Data directly from you, from your use of the Application’s fitness and coaching features, and from health, fitness, or wearable services you choose to connect. BROADS does not use personal information to infer medical diagnoses or health conditions.

3. How We Use and Process Consumer Health Data: We collect, use, and process Consumer Health Data to provide the memberships, coaching, fitness, tracking, and other Services you request; personalize fitness plans and training recommendations; track fitness activity, goals, and progress; facilitate communications with coaches; support connected health and fitness features; maintain and secure Member Accounts; respond to requests; comply with applicable law; and establish, exercise, or defend legal claims. Consumer Health Data is processed electronically through the Application and systems used to provide the Services. It may be associated with your Member Account, combined with other information you submit, used to provide fitness or coaching recommendations, and made available to authorized recipients as described below. Where applicable law requires consent or authorization, we will obtain the applicable consent or authorization before collecting, sharing, selling, or otherwise processing Consumer Health Data, unless the processing is necessary to provide a product or Service you requested or another exception applies. Connecting a health, fitness, or wearable service is optional, and you may withdraw permission for future collection through the applicable service or device settings.

4. Consumer Health Data We Disclose: Any category of Consumer Health Data described in Section 1 may be disclosed only as reasonably necessary to provide the Services you request, at your direction or with your consent, or as otherwise permitted or required by law. Consumer Health Data may be disclosed to:

  1. Exercise.com, a Daxko LLC brand, which provides the technology platform, hosting, coaching and fitness functionality, and connected health and fitness integrations used to operate the Application;

  2. Your assigned coach, the lead coach, and authorized operational personnel where reasonably necessary to provide, supervise, support, secure, or administer the Services;

  3. Health, fitness, or wearable services you choose to connect;

  4. Service providers that process Consumer Health Data on our behalf where reasonably necessary to host, maintain, secure, support, or provide the Services; and

  5. Legal, governmental, or business-transaction recipients where permitted or required by applicable law.

5. Where BROADS Does Not Disclose: BROADS does not currently disclose Consumer Health Data to any corporate affiliate. BROADS does not sell Consumer Health Data or use or disclose Consumer Health Data for targeted advertising, cross-context behavioral advertising, or other marketing purposes. We do not permit third parties to collect Consumer Health Data through the Services over time and across different websites or online services for advertising or marketing purposes.

6. Your Consumer Health Data Rights: Depending on where you live and subject to applicable exceptions, you may have the right to:

  1. Confirm whether BROADS collects, uses, shares, or sells Consumer Health Data concerning you;

  2. Access or request correction of your Consumer Health Data;

  3. Obtain a list of third parties and affiliates with whom BROADS has shared or sold your Consumer Health Data, including available contact information;

  4. Withdraw consent and request that BROADS cease future collection or sharing of Consumer Health Data;

  5. Request deletion of your Consumer Health Data; and

  6. Appeal a decision concerning your request.

7.  To Exercise a Right: To exercise a right, email info@broads.app with the subject line “Consumer Health Data Request.” Please describe your request and provide information reasonably necessary to identify your Member Account and authenticate your identity. You are not required to create a new account to submit a request. We will respond within the period required by applicable law. Where Washington or Nevada consumer health privacy law applies, we will generally respond within 45 days. We may extend the response period by an additional 45 days where reasonably necessary and permitted by law, provided we notify you within the initial response period. If we deny your request, you may appeal by emailing info@broads.app with the subject line “Consumer Health Data Appeal.” If we deny the appeal, we will provide information about how to contact the applicable attorney general or regulatory authority. When required by applicable law, we will delete Consumer Health Data covered by an authenticated request and notify applicable processors, contractors, and third parties that received the information. Deletion from backups may be delayed as permitted by applicable law, including for no more than six months under Washington law and no more than two years under Nevada law. Deleting information necessary to provide the Services may require cancellation of an active subscription or prevent us from providing some or all of the Services. BROADS will not unlawfully discriminate against you for exercising an applicable Consumer Health Data right.

8. Changes, Contact Information, and Effective Date

If we collect an additional category of Consumer Health Data, process Consumer Health Data for an additional purpose, or disclose it to an additional category of recipient not described in this notice, we will update this policy and obtain consent or authorization where required before beginning the additional processing.

We will notify consumers of material changes to this Consumer Health Data Privacy Policy by posting the updated policy through the Site or Application and revising the “Last Updated” date above. If required by applicable law, we will provide additional notice or obtain consent before collecting, using, or disclosing previously collected Consumer Health Data for a materially different purpose or in a materially different manner.

This Privacy Policy describes how Tara LaFerrara LLC, a Texas limited liability company doing business as BROADS  (“BROADS”, "we", "our", or "us"), collects, uses, discloses, retains, and protects personal information when you access or use the BROADS mobile application (the “Application”), our website (the “Site”), and the content, membership programs, retreats, coaching, and other products or services we make available through the Application or Site (collectively, the “Services”).

Please read this Privacy Policy and the Terms of Use before using this Site and Application. BROADS determines the purposes and means of processing the personal information described in this Privacy Policy, except where another entity processes personal information for its own purposes as described in its privacy notice. By accessing or using the Services, you acknowledge that you have reviewed this Privacy Policy. Where applicable law requires us to obtain consent for a particular collection, use, or disclosure of personal information, we will request that consent separately.

1. COLLECTING YOUR INFORMATION AND HOW IT IS USED

We collect personal information when you provide it to us, when you use the Services, and from service providers and other sources that support the Services. The information we collect depends on how you interact with BROADS, the membership level you select, the features you use, and the permissions you provide.

A. Information you choose to provide to us:

We may collect the following information that you provide directly to us:

  1. Account and contact information: Your name, email address, telephone number, username, password, date of birth, billing address, and other information used to create or manage your account.

  2. Profile and demographic information: Your age and other profile or demographic information you choose to provide.

  3. Health and fitness information: Depending on the Services you use, you may provide information concerning your height, weight, fitness goals, exercise activity, habits, progress, physical limitations or injuries, health concerns, menstrual cycle, and other health or fitness information you choose to disclose. Information submitted through private coaching features may be accessed by authorized coaches and personnel as described in Section 1(D), “How Personal Information Is Used and Disclosed.”

  4. Coaching information: If you participate in individual coaching, we collect information you provide through questionnaires, check-ins, coach messages, progress updates, photographs, and other communications with your coach. This information may include health and fitness information.

  5. Photographs: Depending on the Services and features you use, you may choose to upload profile, progress, or other photographs. We use photographs to provide the features or coaching Services for which they were submitted. Photographs submitted through private coaching features may be viewed by the member’s assigned coach, the lead coach, and authorized operational personnel as reasonably necessary to provide or administer the Services. We do not use member photographs in testimonials, advertising, or other promotional materials without separate permission. We do not currently use facial recognition, body-geometry measurement, or other automated technology to derive biometric identifiers or body measurements from uploaded photographs.

  6. Communications and user content: We collect information you provide through emails, support requests, surveys, reviews, comments, community features, and other communications with us.

  7. Transaction information: When you purchase a membership or other Services, we collect information concerning your transaction, subscription, and payment status. Payment-card or bank-account information is processed by our payment processor as described below.

You may choose not to provide certain personal information. However, some information is necessary to create an account (“Member Account”), purchase a membership, access particular features, or receive coaching Services. Certain community or profile features may allow you to make information visible to other members. We will identify when information will be publicly or community-visible rather than private. Please use care when submitting information through community features because other members may view, copy, or reshare information you choose to post.

Some information collected through the Services may constitute “Consumer Health Data” under applicable state law. Additional information concerning our collection, use, disclosure, and retention of Consumer Health Data—and the rights available to consumers—is provided in the  “Consumer Health Data Privacy Policy”.

B. Information from third parties and connected services:

We may receive personal information from service providers and other sources that support the Services. For example:

  1. Payment processors: Our payment processor may provide us with transaction information, payment status, billing information, and limited information concerning your payment method.

  2. Application and membership providers: Providers of application hosting, account management, authentication, community, and membership functionality may provide information necessary to create and manage Member Accounts and provide requested features.

  3. Email and communications providers: Email, customer-relationship-management, and communications providers may provide information concerning your subscription preferences and interactions with our communications.

  4. Analytics providers: Analytics providers may provide information concerning the use, performance, and operation of the Site or Application.

  5. Social-media platforms: We may receive information when you interact with BROADS through a social-media platform. The information available to us depends on your interaction with the platform and its privacy settings.

  6. Connected Health and Fitness Services: If you choose to connect a compatible health, fitness, or wearable service to the Application, we may receive information from that service based on the permissions you provide. Depending on the service and permissions selected, this information may include basic account information, exercise and workout history, activity information, and health measurement data. Compatible services may include Apple Health, Fitbit, MyFitnessPal, Runkeeper, MapMyRun, Withings, and other services supported through our application platform. Information from another service, such as Oura, may also become available through an intermediary service such as Apple Health if you enable the applicable connections. Connecting an outside health or fitness service is optional. You control which permissions you grant and may revoke permissions through the applicable third-party service or device settings. Revoking a connection will prevent future collection through that connection but may not automatically delete information previously received. You may request deletion as described in Section 3, “Privacy Rights and Choices,” and in the “Consumer Health Data Privacy Policy.”

C. Information automatically collected:

  1. Automatic Data Collection: When you use the Site or Application, we and our service providers may automatically collect information such as your Internet Protocol (“IP”) address, device type, operating system, browser type, application version, mobile carrier, device and application identifiers, general location derived from your IP address, time zone, Internet service provider, pages or screens viewed, links or buttons selected, content and features used, dates and times of access, and application performance, crash, and diagnostic information. We use this information to operate the Services, maintain security, troubleshoot technical issues, understand how the Services are used, and improve their performance and functionality. We use Google Analytics on the Site and within the Application to help us understand how users interact with the Services and to measure and improve their functionality and performance. Google Analytics may collect information such as IP address, device and browser information, application identifiers, general location derived from IP address, pages or screens viewed, features used, links or buttons selected, access dates and times, and application performance information. We do not intentionally provide the content of private coaching communications, information entered into health or fitness fields, connected health or wearable data, or private progress photographs to Google Analytics. Additional information concerning Google’s processing practices is available through Google’s privacy disclosures.

  2. Cookies and Similar Technologies: We and our service providers may use cookies, pixels, web beacons, server logs, local storage, software development kits (“SDKs”), or other similar tracking technologies to operate the Services and collect information about their use. These technologies may be used to keep you signed in and remember your preferences; provide requested functionality; maintain security and prevent fraud; understand how the Services are used; measure and improve performance; identify technical errors; determine whether communications have been opened or acted upon; and deliver or measure advertising. Information collected through these technologies may include identifiers and other information that qualifies as personal information under applicable law. Some technologies are necessary for the Services to function. Depending on your location and the technologies in use, you may be able to manage nonessential technologies through a cookie-preference tool, your browser settings, device settings, or other opt-out mechanisms described in this Privacy Policy. 

  3. Advertising and Measurement Technologies: We may use Meta Pixel on the Site to measure advertising performance, understand interactions with the Site, and attribute registrations or purchases to advertisements. Meta Pixel may collect information such as IP address, device and browser information, device or advertising identifiers, pages viewed, interactions with the Site, and information concerning registrations or purchases. We do not upload member email lists to Meta to create custom or lookalike advertising audiences. Meta Pixel is not intended to collect information from private areas of the Application or information concerning private coaching communications, health or fitness information entered by members, connected health or wearable data, or private progress photographs. Depending on applicable law, disclosures through advertising technologies may be considered a “sale,” “sharing,” or processing for targeted advertising even though BROADS does not receive money in exchange for the information. Additional information concerning applicable choices is provided in Section 4, “Communication, Tracking, and Account Choices,” and Section 7, “Sale, Sharing and Targeted Advertising.”

D. How Personal Information Is Used and Disclosed:

  1. We do not use Consumer Health Data for advertising or marketing purposes or to make decisions concerning employment, insurance, credit, housing, or other eligibility determinations. We may use personal information to:

    1. Create, authenticate, maintain, and secure Member Accounts;

    2. Provide memberships, individual coaching, community features, and other requested Services;

    3. Process subscriptions, payments, cancellations, and related transactions;

    4. Communicate with you about your account, membership, coaching, purchases, and support requests;

    5. Send newsletters and promotional communications in accordance with your preferences;

    6. Personalize your experience and provide fitness or training recommendations;

    7. Monitor, maintain, troubleshoot, and improve the Services;

    8. Conduct internal analytics and understand how the Services are used;

    9. Protect the rights, safety, security, and integrity of BROADS, our users, and others;

    10. Detect and prevent fraud, misuse, and unlawful activity;

    11. Enforce our Terms of Use and other agreements;

    12. Comply with legal obligations and respond to lawful requests;

    13. Establish, exercise, or defend legal claims;

    14. Create aggregated or deidentified information that cannot reasonably be used to identify you; and

    15. Carry out another purpose disclosed to you when the information is collected or with your consent.

  2. We may disclose personal information to the following categories of recipients:

    1. Service providers: We disclose personal information to providers that assist with payment processing, application hosting and functionality, data storage, account management, connected health and fitness integrations, customer-relationship management, email delivery, customer support, analytics, business communications, internal operations, security, error monitoring, and other operational activities. These providers may include Exercise.com, Stripe, Google, ClickUp, and GoHighLevel. Exercise.com, a Daxko LLC brand, provides the technology platform, hosting, account-management features, coaching and fitness functionality, and connected health and fitness integrations used to operate the Application.

    2. Advertising and measurement providers: We may disclose certain device identifiers, Internet activity information, and information concerning Site registrations or purchases to Meta and other advertising or measurement providers as described in Section 1(C), “Information Automatically Collected.” These technologies are not intended to collect Consumer Health Data, private coaching communications, connected health or wearable data, or private progress photographs.

    3. Coaches and authorized personnel: Authorized BROADS coaches, personnel, and contractors may access information reasonably necessary to provide or administer the Services. A member’s assigned coach may access information concerning that member, including coaching communications and health and fitness information submitted in connection with the coaching Services. The lead coach may access information concerning coaching members as reasonably necessary to oversee and administer the coaching Services. Authorized operational personnel may access information as reasonably necessary to manage accounts, respond to support requests, maintain the Services, and perform other operational functions. Personnel responsible for marketing may access limited contact, membership, communication-preference, and marketing information but are not authorized to access private coach messages, health and fitness information, connected health or wearable data, or private progress photographs for marketing purposes.

    4. Payment processors: Payment information and transaction details may be disclosed to payment processors to complete transactions, prevent fraud, process refunds, and manage subscriptions.

    5. Legal and governmental recipients: We may disclose information when required by law, legal process, or governmental request, or when reasonably necessary to protect rights, safety, security, or property.

    6. Business-transfer recipients: Information may be disclosed as part of an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to appropriate confidentiality protections.

    7. Other recipients at your direction: We may disclose information when you direct us to do so or provide consent.

2. RETENTION AND SECURITY

  1. Retention: We retain personal information for as long as reasonably necessary to provide and administer the Services and for legitimate business purposes, including legal, tax, accounting, security, fraud-prevention, and dispute-resolution purposes. Ending a membership or canceling a subscription does not automatically delete the associated Member Account or personal information. Members may completely delete their Member Account after all active subscriptions have been canceled. Members may also submit a request concerning deletion of personal information as described in Section 3, “Privacy Rights and Choices.” If a member maintains an active subscription, deleting information necessary to provide the Services may require cancellation of the subscription or may prevent BROADS from continuing to provide some or all of the Services. Certain information may be retained when reasonably necessary to comply with legal or financial obligations, resolve outstanding account matters or disputes, prevent fraud, or maintain security. Information may also remain in archived or backup systems for a limited period before deletion through ordinary backup processes.

  2. Security: We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, use, alteration, disclosure, or destruction. These safeguards may include access controls, authentication measures, vendor management, and limitations on personnel and coach access based on business need. No method of transmitting information over the Internet or storing information electronically is completely secure. Accordingly, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your Member Account credentials and should notify us promptly if you believe your account has been accessed without authorization. Please do not send sensitive health, payment, or other confidential information through unsecured email. When available, use the secure communication features provided through the Application.

3. PRIVACY RIGHTS AND CHOICES

Depending on where you live and subject to applicable exceptions, some or all of the rights described below may be available to you.

  1. Rights that may be available:

    1. Confirm whether we process your personal information;

    2. Request access to personal information we maintain about you;

    3. Request correction of inaccurate personal information;

    4. Request deletion of personal information;

    5. Obtain a portable copy of certain personal information;

    6. Withdraw consent where we rely on consent to process personal information;

    7. Opt out of certain processing for targeted advertising, sale, or profiling, if applicable;

    8. Obtain information concerning certain disclosures of your personal information;

    9. Appeal our decision concerning a privacy request; and

    10. Exercise your rights without unlawful discrimination.

  2. Submitting a request:

    1. You may submit a request by emailing info@broads.app with the subject line “Privacy Request.” Please describe the right you wish to exercise and provide the information reasonably necessary for us to identify your account and verify your request.

      1. We may request additional information to verify your identity and protect personal information from unauthorized access or deletion. We will use information provided for verification only to process and document the request. If we cannot verify a request, we may be unable to fulfill it.

      2. Where permitted by applicable law, an authorized agent may submit a request on your behalf. We may require proof of the agent’s authority and may contact you directly to verify your identity and confirm the request.

      3. If we deny your request, you may appeal the decision by emailing info@broads.app with the subject line “Privacy Appeal” and explaining the basis for your appeal.

      4. You may also update certain information directly through your Member Account, if the applicable functionality is available.

      5. Additional rights relating to Consumer Health Data are described in the  “Consumer Health Data Privacy Policy.”

4. COMMUNICATION, TRACKING, AND ACCOUNT CHOICES

  1. You have the following choices concerning communications, account information, and certain tracking technologies:

    1. Email: You may opt out of promotional emails by using the unsubscribe link included in the email or by contacting info@broads.app. Even if you opt out of promotional emails, we may continue sending nonpromotional communications concerning your account, transactions, coaching Services, security, or our ongoing business relationship with you.

    2. Text messages: If you consent to receive promotional text messages, you may opt out by following the instructions in the message, such as replying STOP. Consent to promotional text messages is not a condition of purchase. We may continue sending nonpromotional or transactional messages where permitted by law.

    3. Push notifications: You may manage push notifications through the Application settings or your device settings.

    4. Account cancellation and deletion: Canceling a subscription does not necessarily delete your Member Account or personal information. You may request account deletion by emailing info@broads.app. Certain information may be retained as permitted or required by law and as described in the Retention section. Deleting information necessary to provide the Services may result in cancellation of an active membership or loss of access to certain Services.

    5. Cookies and tracking: You may be able to manage cookies and similar technologies through your browser or device settings and, where available, our cookie-preference tool. Disabling certain technologies may affect the availability or operation of the Services.

    6. Website users may be able to limit Google Analytics through Google’s currently available browser opt-out add-on at https://tools.google.com/dlpage/gaoptout. This browser add-on does not control analytics within the Application. Mobile users may have additional choices available through their device or Application privacy settings.

  2. Tracking Disclosures and California Privacy Disclosures:

    1. Do Not Track: Some browsers offer a “Do Not Track” setting. Because there is not currently a universally accepted standard for responding to Do Not Track signals, our response may vary.

    2. Global Privacy Control: Some jurisdictions require recognition of qualifying browser-based universal opt-out signals, such as Global Privacy Control. Where required by applicable law, we process qualifying signals as requests to opt out of the sale or sharing of personal information or targeted advertising for the browser or device transmitting the signal.

    3. California’s “Shine the Light” law permits certain California residents to request information concerning disclosure of personal information to third parties for those third parties’ direct-marketing purposes. BROADS does not disclose personal information to third parties for their own direct-marketing purposes without consent. Questions may be submitted to info@broads.app.

5. ADDITIONAL INFORMATION FOR INDIVIDUALS IN THE EEA, UNITED KINGDOM, AND SWITZERLAND

If you are located in the European Economic Area (“EEA”), United Kingdom (“UK”), or Switzerland and applicable data protection law applies to our processing of your personal data, the following information supplements the other provisions of this Privacy Policy. For purposes of applicable data protection law, Tara LaFerrara LLC is the controller of the personal data described in this Privacy Policy unless otherwise stated.

  1. Legal Bases for Processing: Depending on the circumstances, we process personal data based on one or more of the following legal bases:

    1. Performance of a contract, including to create and manage your Member Account, process payments, and provide memberships, coaching, and other Services you request;

    2. Your consent, including where required for marketing communications, nonessential tracking technologies, optional connected health and fitness services, and health or fitness information;

    3. Our legitimate interests, including operating, securing, maintaining, and improving the Services; understanding how the Services are used; preventing fraud and misuse; providing customer support; maintaining business records; and protecting our legal rights, provided those interests are not overridden by your rights and interests; and

    4. Compliance with legal, tax, accounting, regulatory, or reporting obligations and the establishment, exercise, or defense of legal claims.

  2. Special-Category Health Information: Health information may constitute special-category personal data under applicable law. Where required, we process health information based on your explicit consent. You may withdraw consent at any time, but withdrawal will not affect the lawfulness of processing conducted before consent was withdrawn. If you decline to provide or withdraw consent to information necessary for a requested feature or coaching Service, we may be unable to provide that feature or Service.

  3. International Transfers: BROADS is located in the United States, and personal data may be transferred to, stored in, or processed in the United States and other countries in which our service providers operate. These countries may have different data protection laws than your country of residence. Where applicable law requires safeguards for an international transfer, we rely on a legally recognized transfer mechanism, which may include an adequacy decision, contractual protections approved by the applicable authority, or another lawful transfer mechanism. You may contact us to request additional information concerning applicable transfer safeguards.

  4. Your Data Protection Rights: Subject to applicable law and exceptions, you may have the right to:

    1. Request access to your personal data;

    2. Request correction of inaccurate or incomplete personal data;

    3. Request deletion of your personal data;

    4. Request restriction of processing;

    5. Object to processing based on our legitimate interests;

    6. Object at any time to processing for direct-marketing purposes;

    7. Receive certain personal data in a structured, commonly used, and machine-readable format;

    8. Withdraw consent where processing is based on consent; and

    9. Lodge a complaint with the data protection authority responsible for your location.

  5. Exercising Your Rights: You may exercise applicable rights as described in Section 3(B), “Submitting a Request.” Individuals in the UK may contact the UK Information Commissioner’s Office, and individuals in Switzerland may contact the Federal Data Protection and Information Commissioner.

  6. Automated Decision-Making: BROADS does not use personal data to make decisions based solely on automated processing that produce legal or similarly significant effects concerning you.

  7. 6. SALE, SHARING AND TARGETED ADVERTISING

BROADS does not sell personal information for monetary consideration. We may disclose certain identifiers, device information, Internet activity information, and information concerning Site registrations or purchases to advertising and measurement providers, including Meta. Depending on applicable law, these disclosures may be considered a “sale,” “sharing,” or processing for targeted advertising even though BROADS does not receive money in exchange for the information.

BROADS does not upload member email lists to Meta to create custom or lookalike advertising audiences. Advertising technologies on the Site are not intended to collect Consumer Health Data, private coaching communications, connected health or wearable data, or private progress photographs.

Depending on where you live, you may have the right to opt out of these activities. You may exercise applicable rights as described in Section 3, “Privacy Rights and Choices,” and Section 4, “Communication, Tracking, and Account Choices.”

7. CHILDREN’S PRIVACY

The Services are intended only for adults who are at least 18 years old. You may not create a Member Account, purchase a membership, or use the Services if you are under 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take reasonable steps to delete it. If you believe a person under 18 has provided personal information through the Services, please contact us at info@broads.app.

8. THIRD-PARTY SERVICES AND LINKS

The Services may contain links to websites, applications, or services operated by third parties. This Privacy Policy does not apply to third-party services that BROADS does not control. We encourage you to review the applicable third party’s privacy notice before providing personal information to that service. A third-party service may process information on our behalf as a service provider while also separately collecting information through its own service. Its independent processing is governed by its own privacy notice. When you connect a third-party health, fitness, or wearable service, that third party’s independent collection, use, retention, and disclosure of information is governed by its own privacy notice and your settings with that service.

9. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes to our practices, Services, or legal obligations. When we update the Privacy Policy, we will revise the “Last Updated” date at the top. If we make a material change, we will provide additional notice as appropriate under the circumstances, such as by posting a notice through the Services or sending a notification to the email address associated with your Member Account.
